Primetime Cheer

1. Acceptance of Terms

By creating an account, booking a lesson, or using this platform, you agree to these Terms of Service. If you are creating an account or booking on behalf of a minor, you represent that you are the parent or legal guardian of that minor and agree to these terms on their behalf.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information when creating your account and to update your information as needed. You must be at least 18 years old to create an account. Participants under 18 must have an account created by their parent or legal guardian.

3. Booking and Cancellation

Lesson bookings are subject to instructor availability and may require a signed waiver before confirmation. Cancellation policies are set by Primetime Cheer and are displayed during the booking process. Please review the cancellation policy carefully before completing your booking. Failure to appear for a booked lesson without cancellation may be subject to the applicable no-show policy.

4. Waivers and Assumption of Risk

Participation in physical activities involves inherent risks. You may be required to sign an electronic waiver before booking. By signing a waiver, you acknowledge that you have read and understood the terms of the waiver, including assumption of risk and release of liability. Waivers are valid for one year from the date of signing unless otherwise specified.

5. Payments

When online payments are enabled, payment processing is handled by Stripe, Inc. By making a payment, you agree to Stripe's terms of service. Prices are displayed at the time of booking and may vary by instructor or service. Refund eligibility is determined by Primetime Cheer's cancellation policy.

6. User Conduct

You agree to use the platform only for its intended purpose of booking and managing lessons. You agree not to misuse the platform, interfere with its operation, or access it through unauthorized means.

7. Intellectual Property

The platform, including its design, features, and content, is owned by CheerOS and protected by applicable intellectual property laws. Primetime Cheer's branding, logo, and business content are owned by Primetime Cheer. You may not reproduce, distribute, or create derivative works from any platform content without permission.

8. Limitation of Liability

The platform is provided “as is” without warranties of any kind. CheerOS is a technology platform that facilitates booking between Primetime Cheer and its customers. CheerOS is not responsible for the quality, safety, or delivery of lessons or services provided by Primetime Cheer or its instructors. To the fullest extent permitted by law, neither CheerOS nor Primetime Cheer shall be liable for any indirect, incidental, or consequential damages arising from use of the platform.

9. Dispute Resolution

Any disputes arising from these terms or your use of the platform shall be resolved in accordance with the laws of the State of New York. You agree to attempt to resolve disputes informally by contacting Primetime Cheer before pursuing formal action.

10. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify you of significant changes through the platform or by email.
