CheerOS Terms of Service

1. Acceptance of Terms

By creating an account, booking a lesson, or otherwise using the CheerOS platform, you agree to these Terms of Service. If you create an account or book on behalf of a minor, you represent that you are the parent or legal guardian of that minor and agree to these terms on their behalf.

2. About the Platform

CheerOS is a technology platform that provides scheduling and booking tools to activity businesses (“organizations”), such as gyms and independent coaches. Organizations — not CheerOS — deliver the actual lessons, classes, and services. Your booking relationship for a given lesson is with the organization you book with.

3. Account Responsibilities

You are responsible for keeping your account credentials confidential and for activity under your account. You agree to provide accurate information and keep it current. You must be at least 18 years old to create an account; participants under 18 must have an account created by a parent or legal guardian.

4. Scheduling, Bookings, and Availability

Bookings are subject to instructor availability and may require a signed waiver before confirmation. Availability, services, durations, and pricing are configured by each organization and may change. Submitting a booking request does not guarantee a booking until it is confirmed by the platform.

5. Cancellations and No-Shows

Cancellation and refund policies are set by the organization and are displayed during booking. Please review them before completing a booking. Failure to appear for a booked lesson without cancellation may be subject to the organization's no-show policy.

6. Waivers and Assumption of Risk

Participation in physical activities involves inherent risks. You may be required to sign an electronic waiver before booking. By signing, you acknowledge you have read and understood the waiver, including assumption of risk and release of liability. Waivers are valid for one year from signing unless otherwise specified.

7. Payments

When online payments are enabled, processing is handled by Stripe, Inc., and you agree to Stripe's terms. Prices are shown at the time of booking and may vary by instructor or service. Refund eligibility is determined by the organization's cancellation policy.

8. Acceptable Use

You agree to use the platform only for its intended purpose of booking and managing lessons. You agree not to misuse the platform, disrupt its operation, attempt to access it through unauthorized means, or use it to violate any law or the rights of others.

9. Intellectual Property

The platform, including its design, features, and content, is owned by CheerOS and protected by applicable intellectual property laws. An organization's branding, logo, and business content remain owned by that organization. You may not reproduce, distribute, or create derivative works from platform content without permission.

10. Limitation of Liability

The platform is provided “as is” without warranties of any kind. CheerOS is a technology platform that facilitates booking between organizations and their customers; CheerOS is not responsible for the quality, safety, or delivery of lessons or services provided by an organization or its instructors. To the fullest extent permitted by law, CheerOS shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform.

11. Changes to These Terms

We may update these terms from time to time. The effective date above will reflect the latest version, and continued use of the platform after changes constitutes acceptance of the updated terms.
